By accepting the estimate with Big Elk Services, you are agreeing to the Terms and Conditions for work to be completed at an agreed-upon price. In the event that you break this agreement, all deposits made to the company shall be surrendered.
1) Warranty
All warranties are limited to those offered by the manufacturers of the products used. Big Elk Services makes no additional warranties. If you ever have a concern regarding our work, Big Elk Services Should be notified immediately.
2) Water Usage:
By accepting the estimate, you agree to provide Big Elk Services the right to use an on-site water supply as needed to complete the stated project without compensation. If an exterior water supply is required, it will be at an additional charge. It is the customer’s responsibility to make sure the water supply is on and in working order before we arrive. Additional charges will be applied if water is not available.
3) Electrical Usage:
By accepting the estimate, you agree to provide Big Elk Services. the right to use an on-site source of electricity as needed to complete the stated project without compensation. If an exterior source is required it will be at an additional charge.
4) Color and Tone Concerns:
The properties and species of wood age and weather can greatly affect the resulting color or tone of the stain. Note: Variances may occur on individual boards as well as the total project, as densities and other characteristics vary across and throughout the wood. While we can often give you an idea of the overall color or tone you must expect some variance in the overall finish.
5) Courtesy:
While Big Elk Services is on location and performing work , you are responsible for keeping all children and pets, as well as other individuals away from the work area. Children and pets must be kept off the work surface for at least 24 hours after our work is completed. This is for your safety as well as our own. Customer agrees to assume responsibility for all injuries or death incurred for all persons who may enter the work area.
6) Payments:
Payments to Big Elk Services are due as per the estimated schedule and are to be paid by check or cash. All balances are ALWAYS due upon completion of the job. Any variance to this policy must be agreed upon and in writing. Late fee of 20% or $25, whichever is greater, will be immediately assessed on all balances not paid in accordance with the terms and conditions. The customer agrees to pay any collection cost incurred by Big Elk Services related to the collection process of outstanding balances. Big Elk Services reserves the right to attach a mechanic’s lien against a homeowner’s property for non-payment. An interest rate of 2% per month begins accruing after day 30 of non-payment. Big Elk Services also reserves the right to enter into civil claims court to collect outstanding debt. All legal fees incurred will be added to the remaining unpaid balance.
7) Scheduling:
Scheduling in a business whose productivity relies upon the weather can be difficult. Inclement weather may affect scheduling. We try our best to keep scheduling conflicts to a minimum, however, circumstances that are beyond our control may affect your project start and completion dates. You will be notified of any changes.
8) Removal & Replacement of Contents:
Removal and replacement of grills, deck furniture, trash, planters and any other items are the responsibility of the client and should be a minimum of 8 feet from the surface being cleaned. Should we need to remove items, we will not be responsible for any damage, breakage or for storage issues. An additional charge may be applied for the time and labor devoted to the removal of these items.
9)Screen Removal:
The Client acknowledges and agrees that any and all screens must be removed prior to the
arrival of Big Elk Services. The Company shall not be responsible for removing any screens and shall not be held liable for any damages or losses incurred during the washing process if screens are not removed. Area around screens may not be cleaned.
10) Damages:
Big Elk Services is not responsible for damages due to improperly installed siding, loose shingles or siding, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters, and leaders and improper caulking. In every aluminum siding case and in some cases with vinyl siding, the sun and weather will bleach the color or cause fading. Power washing, which entails the removal of chalky, gritty, or failing surface materials may cause the faded aspects of the vinyl or aluminum to stand out. Big Elk Services will not be responsible for such conditions. Big Elk Services will not be responsible for loose mortar that may dislodge during the cleaning process. Big Elk Services will not be responsible for any damages to vegetation. Client must inform Big Elk Services of any damage within 48 hours of work competition.
11) Stains:
Some stains and grease cannot be removed by power washing. Tree sap, artillery fungus, rust, copper, oil, splatters from stains and paints are examples of materials that are not easily removed by conventional means. Sometimes these stains cannot be removed at all.
12) Watertight:
Big Elk Services expects your property to be in good repair and weathertight. This includes, but is not limited to all electrical services including receptacles and light fixtures. Doors and windows shall also be weathertight. Big Elk Services Services is not responsible for damages as a result of water infiltration from poor or improper installation, maintenance, or repair of electrical-related items or doors or windows. Big Elk Services cannot guarantee removal of artillery fungus from exterior house surfaces.
13) Window Spotting:
Windows may become water spotted as a result of our services. Window cleaning is not included.
14) Concrete:
The appearance of concrete depends on a number of factors most linked to when the concrete was initially poured and cured. When concrete with dirt, mold, mildew, algae and other pollutants and stains is cleaned, the concrete will then reveal any and all imperfections that the pollutants and stains have covered up. The customer understands that not all concrete will look the same even on the same driveway, patio, sidewalk, or concrete slab.
15)Mobilization Fee:
A fee of 20% of the estimate or $25, whichever is greater, will be charged if work is unable to be performed due to things such as but not limited to, pets in work area, insufficient parking, obstructions, property deemed unfit for washing, ect. Same fees apply if service is cancelled without 48 hours notice.
16) Parking:
You Agree to provide Big Elk Services sufficient parking space. If there is no sufficient parking space you agree Big Elk Services may park on the lawn of the property. Big Elk Services is not responsible for any damages done to the lawn due to insufficient parking.
17) Media Release:
By accepting the estimate you allow Big Elk Services to utilize any photos, descriptions, reviews, quotes, or videos of the property and/or the client in the context of marketing or advertising for the Company. The company will use these items described in this section without any compensation to the Client. Client agrees not to seek punitive action in a civil court of law regarding the development, display, reproduction, or printing of the above examples of media. This does include the use of photos, addresses, testimonials and videos posted or displayed on online venues such as social media and or the Company’s website. The Client also agrees to allow the Company to display a marketing sign on their property for no more than one week after service.
18) Plant Life:
We are not responsible of the maintenance of the plants, beside light trimming. We are not responsible for the health of the plants as we are not in control of the watering, weather, temperatures, fungus, insects and animals, or any other reason outside our control. Watering, feeding, and the health of the plants are at the client's responsibility.
19) Gates:
Please make sure all gates are unlocked so the crew has access to your backyard. Our teams always do the best they can to close all backyard gates after work is performed. But it is to the client's responsibility to check if all gates are shut properly before letting their pets return back in the yard. Big Elk Services will not be responsible if pets escape the yard after service of property.
20) House Wash:
House wash in washing the exterior vinyl siding to remove mildew, dirt, grime and algae. Some stains and things such as types of fungus may not be removed due to safety and damages. House Wash does not include brick, stone of other type of exterior house sides.
20)Agreement to Terms:
By accepting an estimate, you agree that all conditions are satisfactory and hereby accepted. You authorize Big Elk Services To do work as specified on the proposal/estimate.
